Under Article 67(1) EPC, from the date of its publication a European patent application provisionally confers on the applicant such protection as is conferred by Article 64 EPC in the contracting states designated in the application as published, i.e. the same rights would be conferred by a Czech patent granted, if translation is provided and administrative fee for translation is paid.
A translation of the patent specification into Czech must be supplied under the conditions provided for in Art. 65(1) EPC. Furthermore, an applicant with neither residence nor principal place of business on the territory of the Czech Republic must be represented by a patent attorney.
Period for filing the translation is 3 months after the date on which the mention of grant or the decision to maintain the patent as amended is published in the European Patent Bulletin. Extension of the time limit is possible.
Submission of translation of specification of the European patent within the supplementary period is also possible.
